Preamble

The present Terms of Use govern access, navigation and use of all platforms, services, content, tools and programs operated by Le Magazine Hip-Hop inc., a company legally incorporated in Quebec (Canada).

They constitute the general framework of use applicable to any person who consults, uses or interacts with the digital ecosystem operated by Le Magazine Hip-Hop inc., including its divisions, digital showcases, services and programs.

Using any platform or service within the ecosystem implies full, complete and unconditional acceptance of the present Terms of Use.

  • Any direct or indirect interaction with the ecosystem

They apply regardless of place of residence of the user, subject to applicable local laws.

3. Ecosystem, divisions and services involved

The present Terms of Use include, but are not limited to:

  • Magazine Hip-Hop (editorial division)
  • Underground Network (central digital platform)
  • The Portal (official channel for requests and services)
  • Hip-Hop University (educational platform)
  • Mag HH Shop (services, products and documents)
  • Affiliate Program
  • Terms of Service – Emergency Management Center
  • Any other division, program or service, current or future, operated by Le Magazine Hip-Hop inc.

None of these divisions possesses a separate legal personality.

4. Nature of the platforms and lack of guarantee

The platforms and services are provided:

  • For purposes informative, cultural, educational or community
  • No obligation to achieve a result
  • Without guarantee of continuity, availability or performance

Accessing or using a platform does not create:

  • No partnership
  • No mandate
  • No employment relationship
  • No automatic contractual obligation

5. User Accounts and Responsibility

When an account is required:

  • The user is responsible for the information provided.
  • He must maintain accurate and up-to-date data
  • He is responsible for maintaining the confidentiality of his login credentials.
  • Any activity carried out using his account is attributable to him.

Account sharing, identity theft, or unauthorized access are strictly prohibited.

  • User-submitted content remains their responsibility.

Any unauthorized reproduction, distribution or exploitation is prohibited.

The user guarantees that they hold the necessary rights to the content they submit.

8. Moderation, suspension and termination

Le Magazine Hip-Hop inc. reserves the right, at its sole discretion, to:

  • Suspend or terminate an account
  • Restricting access to all or part of a service
  • Terminate a program or feature

No detailed justification is required, except where legally obligated.

In case of conflict or differing interpretations, the order of priority is as follows:

  3. Policies & Terms – Underground Network
  4. Policies specific to divisions and departments
  5. Operating Guides
  6. Explanatory summaries

The higher-level document prevails at all times.

10. Personal Data and Technologies

Personal information is processed in accordance with:

  • To the Privacy Policy
  • To the Cookie Policy
  • Applicable laws, including but not limited to:
    • Bill 25 (Quebec)
    • PIPEDA (Canada)
    • GDPR (European Union), where applicable

11. Limitation of Liability

To the fullest extent permitted by law, Le Magazine Hip-Hop inc. cannot be held responsible:

  • Regarding the use or interpretation of the content
  • Decisions made by users
  • Financial, professional, or artistic losses
  • Interruptions, malfunctions, or unavailability
  • Content published by users or third parties

The platforms are provided as is.

12. Modification of the Terms and Conditions

Le Magazine Hip-Hop inc. reserves the right to modify these Terms of Use at any time.

The version published on official platforms is the only valid version.

Continued use of the services constitutes acceptance of the updated terms and conditions.

13. Applicable Law and Jurisdiction

The present Terms of Use are governed by:

  • The laws of the province of Quebec (Canada)
  • And, where required, by applicable European standards

Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Montreal.
