Policies & Terms – Underground Network

Preamble

The present Policies & Conditions govern access to and use of Underground Network, official digital platform operated by Le Magazine Hip-Hop inc., a company legally incorporated in Quebec (Canada).

This document constitutes the main reference document applicable to the use of the Underground Network, legally subordinate to Policies & Conditions – Le Magazine Hip-Hop inc., which remain the supreme legal framework for the entire ecosystem.

Access, registration or use of the Underground Network implies full, complete and unreserved acceptance of these conditions.

1. Definition of entities

Le Magazine Hip-Hop inc.

Company legally constituted and registered in Quebec (Canada).

Le Magazine Hip-Hop inc. is the only entity:

  • Owner of the brands, trade names and platforms
  • Operator of digital infrastructures
  • Final decision-making entity
  • Contracting entity
  • Legally responsible for applicable policies, rules and frameworks

Underground Network

Trade name and operational platform operated by Le Magazine Hip-Hop inc..

The Underground Network :

  • Does not possess any separate legal personality
  • Does not exercise any independent decision-making power

All platforms, services, programs and digital storefronts operated under the brands Magazine Hip-Hop and Underground Network, including in particular Hip-Hop University, The Portal, Mag HH Shop, Affiliate Program, EMC and any current or future division, fall exclusively under the jurisdiction of Le Magazine Hip-Hop inc.

2. Nature and role of the Underground Network

The Underground Network East :

  • A private and regulated social network
  • A structured community platform
  • A multifunctional digital hub
  • An infrastructure for hosting services and programs

It is neither a free public social network, nor an uncontrolled broadcasting service.

3. Hosted Services and Spaces

The Underground Network hosts, among other things:

  • The Portal (Requests, submissions and services)
  • Hip-Hop University (Free and paid educational content)
  • Member areas (Profiles, groups, messaging and forums)
  • Publication spaces (Content, comments and shares)
  • Community tools (Rankings, tables and interactions)
  • Special Programs and Initiatives
  • Administrative, educational and internal tools
  • Any current or future functionality integrated into the platform

Each service may be subject to specific conditions, which remain legally subordinate to these terms and conditions. Policies & Terms – Underground Network.

4. Legal Hierarchy of Documents

In case of conflict, ambiguity or divergent interpretation, the following order of priority applies:

  1. Policies & Conditions – Le Magazine Hip-Hop inc.
  2. Policies & Terms – Underground Network
  3. Policies & Terms specific to hosted services
    (Hip-Hop University, The Portal, Affiliate Program, Terms of Use, Mag HH Shop)
  4. Operating Guides
  5. Explanatory summaries

The higher-level document prevails at all times.

5. Access to the platform

Access to Underground Network maybe :

  • Free
  • Conditional upon registration
  • Subject to profile validation
  • Subject to payment for certain services or features

Le Magazine Hip-Hop inc. reserves the right, at its sole discretion, to:

  • Accept or decline a registration
  • Restricting access to certain areas
  • Suspend, limit or delete an account

6. User Accounts and Security

Each user is responsible for:

  • Information provided during registration
  • Regarding the confidentiality of your login credentials
  • Any activity carried out from his account

Account sharing, identity theft, or unauthorized access are strictly prohibited.

7. Rules of conduct and behavior

All users agree to adopt the following behavior:

  • Respectful
  • Legal
  • Compliant with the platform's rules and values

It is strictly forbidden to:

  • Publishing hateful, violent, discriminatory or defamatory remarks
  • Harassing, intimidating or threatening another member
  • Publishing illegal, fraudulent, or misleading content
  • Using the platform for spam or abusive solicitation purposes
  • Impersonating an official representative without authorization
  • Intentionally disrupting the proper functioning of the platform

8. User-generated content

Users remain fully responsible for the content they publish.

By publishing content, the user:

  • Guarantees to hold all necessary rights
  • Respect copyright and image rights
  • Grants to Hip-Hop Magazine Inc. a non-exclusive, worldwide, royalty-free and revocable license, strictly limited to hosting, displaying, internal distribution, archiving and promoting content within the framework of the operation of the Underground Network and platforms operated by Le Magazine Hip-Hop inc.

9. Intellectual Property

All the elements of Underground Network (Structure, code, interface, logos, names, texts, tools and institutional content) are protected by applicable intellectual property laws.

Any unauthorized reproduction, distribution or exploitation is strictly prohibited.

10. Platform Usage License

Access to Underground Network is granted under a license:

  • Limited
  • Personal
  • Non-exclusive
  • Revocable
  • Non-commercial

It is strictly forbidden to:

  • Copying or reproducing the platform
  • Extract or scrape data
  • Using the content for external commercial purposes
  • Training artificial intelligence systems from content or data

11. Paid Features and Services

Some services or content may be subject to payment.

Unless explicitly stated otherwise:

  • Prices are displayed before purchase
  • Access is personal and non-transferable.
  • All sales are final.
  • No refunds are issued after activation.

12. Personal data and confidentiality

Personal data is processed in accordance with:

  • To the applicable laws, including notably:
    • Bill 25 (Quebec)
    • PIPEDA (Canada)
    • GDPR (European Union), where applicable

13. Moderation, suspension and termination

Le Magazine Hip-Hop inc. may suspend or terminate an account, without refund, particularly in the event of:

  • Violation of these terms and conditions
  • Copyright infringement
  • Harmful or abusive behavior
  • Fraud or misuse

The decisions taken are final, subject to applicable legal obligations.

14. Limitation of Liability

The Underground Network is provided "as is".

Le Magazine Hip-Hop inc. cannot be held responsible:

  • User-generated content
  • Interactions between members
  • Direct or indirect losses
  • Temporary or permanent service interruptions

15. Modifications

Le Magazine Hip-Hop inc. reserves the right to modify these Policies & Conditions at any time.

The continued use of Underground Network this constitutes acceptance of the updated terms and conditions.

16. Applicable Law

These terms and conditions are governed by:

  • The laws of Quebec and Canada
  • And, where applicable, the current European standards
